Togo is a West African country bordered by Ghana to the west, Benin to the east and Burkina Faso to the north. It is one of the smallest countries in Africa, with a population of 7.9 million people. Lomé is the capital and largest city of Togo. While the official language is French, many other indigenous languages are spoken in the country. Togo imports machinery, petroleum and food mainly from France and the Netherlands and exports cocoa, coffee, phosphate and cotton to its main partners, Burkina Faso, China and the Netherlands.
Employment Contracts
In Togo, the employment contract can be either in oral or written format. However, a written contract that identifies the key terms of employment is recommended and certain types of contract must be in writing. A written contract should include: the identity of the worker, date the work started, the professional classification, the agreed base salary, and the duration of the period.

Compensation
Employers are not required to pay employees bonuses but may elect to do so. Bonuses based upon performance are common in Togo.
Working Hours
The standard workweek is 40 hours over six days a week, except for agricultural workers. The maximum hours of work each day is eight hours. Overtime can be performed in exceptional circumstances and must be authorized. Individual employment contacts or collective agreements generally determine the rate and terms of overtime performed during the day or night, public holidays, and days of rest.
Vacation Leave
Employees are entitled to paid annual leave of two and a half days per month of service. However, individual employment contracts or collective agreements can give employees more vacation days.
Sick Leave
In Togo, employees receive six months of sick leave. Individual employment contracts and collective agreements may provide for more favorable sick leave benefits.
Maternity / Paternity Leave
Female employees receive 14 weeks of maternity leave. Up to eight weeks can be taken before birth. It can be extended by three weeks in the event of a pregnancy-related illness.
Employment Termination/Severance
Employment contracts in Togo may be terminated by consent of the employer or the employee. Both parties are required to give a notice of termination or payment in lieu of notice. The notice period generally is between 15 days and one month but may vary depending on the individual employment contract or collective agreement. Severance is between 35% and 45% of the employee’s monthly salary.
